While public sector employees have had this option for three decades, it is still not allowed under current law in the private sector. "Comp time" generally is not permissible in the private sector.

The combination of an employee's right to request payment of accrued "comp time" and the employer's obligation to pay for that time at a potentially higher regular rate of pay than when it was earned would seem to make the arrangement unattractive for many employers.

"Comp time" would only be allowed for employees who have worked at least 1,000 hours for the employer during a period of continuous employment with the employer in the 12-month period before the date of agreement or receipt of "comp time".

But not everyone is happy with the status quo.

DISCUSSION QUESTIONS: Would the passage of a legislation similar to HR 1180 in both Houses of Congress be good for retail industry employers and workers? That doesn't mean it will change.

The bill passed the House with no Democratic support. Employers who coerce employees into choosing comp time would be liable to the employees for double damages.

Federal employees already have the option of choosing comp time over overtime pay.

"Despite the Orwellian language used by this law's Republican supporters, this bill has nothing to do with helping to make jobs more flexible and everything to do with making it just a little easier for corporations and their executives to steal the hard-earned wages of working people", Barrett said.

The bill dubbed the "Working Families Flexibility Act of 2017" passed by a 229 to 197 margin, without a single vote from Democrats.

In May 2016, President Obama asked the Department of Labor to "update and modernize" the overtime rules, raising the salary threshold for overtime pay to $47,476 ($913 a week) - roughly double the level now in place. It was due to take effect in December 2016, but was blocked by a Texas judge.
