The North Gauteng High Court in Pretoria on Thursday ruled that Jacob Zuma should explain the reason for his March 30 cabinet reshuffle that created a lot of furore.

In the chaotic aftermath of the reshuffle many top leaders in the ANC and its alliance said Zuma had told them his decision was based, in part, on an "intelligence report", a copy of which Gordhan at point brandished in public. Jonas was also fired by Zuma.

The party's James Selfe says it is now common cause that such a report was used to fire Gordhan.

The High Court in Pretoria ruled that Zuma must hand over the record of his decision to the DA within five working days. Advocate Ishmael Semenya also held that Zuma's legal team had, in fact, already provided the DA with his reasons for the reshuffle, by way of a letter that vaguely referred to the ANC's mandate derived from voters.

Zuma argued he was exercising his powers in terms of section 91 (2) of the Constitution and that he took an executive decision that deserved protection from disclosure.

"To read into the Constitution that the president must explain himself on the composition of the national executive to the opposition‚ is to use the judiciary to police political decisions and sets a very worrisome precedent‚" Kodwa said.

Zuma, who came to power in 2009, has been accused of corruption but survived several no-confidence votes in parliament thanks to his African National Congress (ANC) majority in the National Assembly.
