Apple's top suppliers dragged into Qualcomm legal battle

Fiscal 3Q17 Won’t Be Great for Qualcomm Technology Licensing

Qualcomm Inc said on Wednesday it filed a complaint against Foxconn Technology Group and other Apple Inc manufacturers for breaching license agreements.

The company has sued the manufacturers for allegedly breaching their licence agreements by failing to pay royalties on the use of Qualcomm's technology in the assembly of Apple iPhones.

In a new move in the on-going dispute between Apple and Qualcomm, the chip supplier has sued four iPhone suppliers directly.

SAN DIEGO Manufacturers that build Apple's iPhone and iPad are being drawn into an escalating dispute between the tech giant and the chipmaker Qualcomm.

New Microsoft Surface Laptop: Specs, Design and New Windows 10 OS
Microsoft's other portable Surface devices include the Surface Pro, which is a tablet, and the Surface Book, which is a 2-in-1. The Microsoft Surface laptop is a 13.5-inch ultrabook which is available with a 2256 x 1506 panel and narrow bezel design.

Qualcomm said it has license agreements stretching back 17 years.

"Our licence agreements with Apple's manufacturers remain valid and enforceable". "Despite being just one of over a dozen companies that contributed to basic cellular standards, Qualcomm insists on charging Apple at least five times more in payments than all the other cellular patent licensors we have agreements with combined". Qualcomm has already filed a countersuit against Apple itself. Qualcomm petitioned U.S. District Judge Lucy Koh, who ruled against Samsung in its case with Apple, to throw out the case in April.

Compal, Pegatron and Wistron representatives didn't respond to emails sent by The Wall Street Journal after working hours, nor did they pick up calls by the Journal after office hours. Qualcomm doesn't appreciate missing out on iPhone money and the company has sued no less than four major Apple partners.

Last week, Bloomberg reported Qualcomm would ask the U.S. International Trade Commission to issue an injunction prohibiting iPhone imports, citing sources familiar with the company's plans. And, that these manufacturers are paying Qualcomm licensing fees for non-Apple products, but not those for the Cupertino-branded devices. "And we said, that is interesting, but that is between you and Apple".

Qualcomm said Apple has agreed to cover the costs incurred by the contract manufacturers.

Qualcomm pioneered a good portion of 3G/4G cellular radio technology and holds thousands of patents on its inventions.

Qualcomm, the largest maker of chips used in smartphones, added in the filing that Apple is trying to force the company to agree to a "unreasonable demand for a below-market direct license". A hearing on the dismissal motion is slated for mid-June.
