"Parties may disagree with the state legislature's policy determinations in enacting SB 4, but nothing in federal immigration law precludes a state from directing law enforcement officers in the state to cooperate with the federal government, rather than merely permitting them to do so on an ad hoc basis".

On Friday, The Trump administration filed court papers to support the Texas state law and is seeking to argue in court hearings in favor of the legislation it says will help keep America safe. It calls for jail time for police chiefs and sheriffs who fail to cooperate in US immigration enforcement.

Under Texas law, police officers generally can not arrest people without probable cause of a crime, and immigration violations often end up in civil court, versus a criminal court. "Together we are going to go into this court and tell the judge that this law is discriminatory, and we reject that", attorney Mimi Marziani said in a press conference outside the courthouse.

Supporters of the measure have said immigrants who do not break the law have nothing to fear.

"Under SB 4, local entities must enforce federal immigration law and must do so regardless of whether such enforcement will divert resources away from more pressing police needs", they said in court filings.

Some cities in Texas say the law, if upheld, could prompt sports organizations and others to boycott the state, similar to the effect of a controversial bathroom bill in North Carolina.

Texas Attorney General Ken Paxton said he is grateful for the DOJ's assistance in defending SB4 against the lawsuit. The Trump administration supports the Texas law, which is slated to take effect September 1.

In a separate case this month, Garcia cast doubt on the legality of some Immigration and Customs Enforcement (ICE) detainer requests at the heart of the law, saying there are times when they can violate the U.S. Constitution.
